A 59-year-old man has settled his High Court action for an award of €3.5million following a life-changing car accident on November 4th 2014.
Finian McKenna now uses a wheelchair as a result of the accident, which occurred through no fault of his own. He is now cared for by his brother. The case was heard before the High Court for assessment of damages.
Mr McKenna brought an action against Castlekeeran Transport Ltd, trading as Farrelly Transport, as well as the driver of the other vehicle involved and two owners of cars parked in the area of the accident.
It was alleged that Mr McKenna was driving near Dunganny, Trim, Co Meath when the vehicle crashed into him while attempting to overtake two parked cars. The claim argued that there was a failure on the part of the driver to keep an adequate lookout, and also that he had attempted to overtake the parked cars when it was unsafe to do so. It was further claimed that the driver had failed to take evasive action to avoid the collision. Concerning the owners of the parked cars, it was alleged that they had parked their vehicles in a dangerous location, creating an emergency on the roadway.
The claims were denied; however, a settlement was reached and approved by the court for €3.5million.
